LEGAL SERVICES
Legal counsel designated by Cooper, Elliott & Sonderman Legal Services Plan LLC (Plan Administrator) will represent utility members, including investigation and discovery; negotiation; litigation and appeal, if necessary, for third party damage to utility facilities subject to the following exclusions:
- Any case, item, matter, or service involving an adversary relationship
between Participating Members in this Legal Services Plan;
- Any case, item, or matter where the covered business has a right to defense or other legal representation through any policy of insurance or any other arrangement providing legal services to the Participating Member. Plan Administrator may accept, but is not obligated to accept, representation of Participating Members as requested by Participating Members' insurance provider, as a separately negotiated service not
covered by this Legal Services Plan.
